Terms of Service

These Terms of Service ("Terms") govern your use of the Birdo Chrome extension and related services ("Service") operated by Birdo ("we," "us," "our"). By installing or using Birdo, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Birdo is an AI-powered Chrome extension that generates email reply suggestions inside Gmail. The Service reads the email you are currently viewing, generates reply intent options and full reply drafts using artificial intelligence, and allows you to insert those replies into Gmail's compose box.

2. Eligibility

You must be at least 13 years of age to use Birdo. By using the Service, you represent that you meet this requirement and that any information you provide is accurate.

3. Account

To use Birdo, you must sign in with a Google account. You are responsible for maintaining the security of your account credentials. You agree to notify us immediately if you become aware of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Send spam, phishing emails, or unsolicited bulk messages.
• Generate content that is unlawful, harmful, threatening, defamatory, obscene, harassing, or otherwise objectionable.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Attempt to reverse engineer, decompile, disassemble, or otherwise extract the source code of the Service.
• Access the Service in order to build a competing product or service.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Circumvent any rate limits, authentication mechanisms, or other security measures.

We reserve the right to suspend or terminate your access to the Service if you violate these Terms.

5. AI-Generated Content

Birdo uses third-party AI models to generate reply suggestions. You acknowledge and agree that:

• AI-generated replies may not always be accurate, appropriate, or complete.
• You are solely responsible for reviewing, editing, and approving any reply before sending it. Birdo does not automatically send emails on your behalf.
• We are not liable for any consequences arising from emails you send using AI-generated content, including but not limited to miscommunication, offense, or factual errors.
• AI output may occasionally produce unexpected or incorrect results. You should exercise judgment before sending any generated reply.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. Key points:

• Email content is processed in real-time to generate replies and is not stored on our servers.
• We share email content with our AI provider (Groq) solely for reply generation. This data is not used for AI model training.
• You consent to this processing by using the Service.

7. Intellectual Property

The Service, including all software, design, text, graphics, and other content, is owned by Birdo and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal or internal business purposes, subject to these Terms.

You retain ownership of any content you create or send using the Service, including emails composed with AI-generated suggestions.

8. Subscription and Payment

• Free tier: Birdo offers a free tier with up to 25 AI-generated replies per day.
• Pro tier: $15/month for up to 10,000 AI-generated replies per day. Billed monthly through Stripe.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
• We reserve the right to change pricing with 30 days' written notice. If you do not agree to a price change, you may cancel before it takes effect.

9. Service Availability

We strive to keep Birdo available at all times, but we do not guarantee uninterrupted or error-free service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service downtime.

10. Third-Party Services

Birdo relies on third-party services including Google (for authentication), Groq (for AI processing), and Stripe (for payments). We are not responsible for the availability, accuracy, or conduct of these third-party services. Your use of these services is subject to their respective terms and privacy policies.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any AI-generated content will be accurate or suitable for your purposes.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service.
• Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 6 months preceding the claim, or $100, whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless Birdo, its owners, and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or any email content you send using AI-generated replies.

14. Termination

• By you: You may stop using the Service and uninstall the extension at any time. You may request account deletion by emailing us.
• By us: We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms or if we discontinue the Service.

Upon termination, your license to use the Service ends immediately. Sections 5, 11, 12, 13, and 16 survive termination.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the extension. Continued use of the Service after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Delaware.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Birdo regarding the Service and supersede all prior agreements and understandings.
